）2019年6月13日，京基御景华城玻璃窗坠落现场（截图深圳蒲典网2019年7月12日讯一个月前，发生在深圳福田京基御景华城的高空坠物（坠物为玻璃窗）夺走了一个6岁男孩的生命，引发全社会的强烈关注。此后一个月，各种高空抛物（坠物）频频见于报端，记深圳大型正规水疗会所者简单梳理了一下：6月13日，福田区京基御景华城，一名男童被高空坠落的玻璃窗砸中。6月16日，男童因抢救无效离世。6月22日，南山区光彩新世纪家园楼下，一块健身用杠铃片坠落致路人李某头部受伤。6月24日，福田区长城花园掉落纱窗，致楼下奥迪车前挡风玻璃出现裂纹。6月25日，福田区万科金色家园新空调主机从11楼坠落。7月6日，龙华区，6岁女童被从天而降的瓶子砸中头部，血流不止。7月11日，龙岗区宝龙小区居民楼从6楼掉落一只宠物狗和一块镜子，砸中楼下一辆轿车，轿车前挡风玻璃受损。参与圆桌会议讨论的嘉宾（深圳市律协供图）君爵会馆背后在这里，深圳蒲典网“张玲说法”栏目的态度是明确的：高空抛物行为不是道德问题，是法律问题。明确了这一点，如何惩治高空抛物（坠物）才能集中火力。日前，《深圳律师》杂志81期思辨与争鸣栏目联合宣传委与民事法律专业委员会共同举办“高空坠物抛物法律思考”主题圆桌会议。今天，我们就来试着还原这场圆桌会议，做一次纯法律角度的探讨。有请各位律师和嘉宾出场，他们是：树宏玲律师（深圳市律协民事法律专业委员会副主任）、林志平律师（深圳市律协民事法律专业委员会委员）、颜宇丹律师（深圳市律协宣传工作委员会副主任）、王宁律师（深圳市律协宣传工作委员会副主任）、余刚律师（深圳市律协宣传工作委员会委员）、曹长兴（深圳市物业管理学会副会长）、刘长森（深圳市住房和建设局法律顾问专家团成员）、邵明（南山区荟芳园业委会主任）。【高空坠物（抛物），谁该承担责任？】树宏玲律师认为，高空坠物及抛物属于民法范畴类的侵权责任。这两个行为的性质是有区别的：第一种行为是坠物。高空坠物在民法侵权责任法中归类于物件损害责任，其最大的特点是没有人的意志加入其中，也就是非人为状况下物件自行坠落。在这种情况下，民法把它称之为物的替代责任。什么是替代责任？物的所有人、管理人、使用人在自己没有明确故意行为之下，由于自己对物品管理、使用不善、不良，使其在特殊情况下坠落，应当由物的所有人、管理人、使用人承担相应的侵权责任。第二种行为是抛物。抛开刑事责任不谈，仅就民事责任来看，它有一个抛字。这是有明确的故意，民法范畴中故意有过错的，是直接侵权责任人。“遇到高空物件坠下，我们判断是自行坠落还是抛落首选报案，交由公安部门侦查。”树宏玲律师强调，并不是所有的事件一定会发生刑事责任，查明责任最好的方式是通过报案，通过侦查查明该物体是人为造成还是非人为造成。比如，确定坠落物属于哪一间房，查明该房的业主、租客或者客人等。如果这个物件不能查明归属，在这栋楼的侧面楼层业主、租客都可能成为侵权人。只要在业主、租客或者其他使用人没法证明自己没有过错的情况下，都要承担相应的责任。“这个责任不是特别典型的侵权责任，实际上是从公平的角度，从补偿受害者角度产生的补偿”，树宏玲律师说。树宏玲律师在圆桌会议上发言（深圳市律协供图）具体到6月13日发生在京基御景华城的玻璃窗坠落事故，林志平律师表示，这个事故可以确定窗户具体从哪一户掉下来，这种情况适用《侵权责任法》第85条，即实际情况承担赔偿责任应该是业主，业主是窗户的所有人、管理人和使用人，这一条是可以确定责任侵权人的。媒体报道过的重庆烟灰缸案、山东菜板案，由于不能确定具体加害人，适用于《侵权责任法》第87条规定，由所有住户承担所有连带责任。王宁律师补充说，“侵权责任法有三种规律：一是过错原则，二是过错推定原则，三是公平原则。第85条是过错推定原则，只要管理人、使用人、所有人不能证明自己没有过错就应当承担责任。只要这件事一发生，法律就推定你们有责任。”余刚律师指出，从以往办案的经验看，最终肯定有人赔偿，不管是公平责任、过错责任或者过错推定责任，很多时候赔偿能力是有限的。比如发生在东莞的苹果砸伤婴儿的案件，，在确定致害人后发现她没有赔偿能力，怎么办？从推动制度建设和责任承担方面来讲，必须有更多的社会力量和其他的，如保险机构、物业管理公司、业委会借鉴其他国家或者地区的做法，把平常的管理、检查和监督的责任做好。圆桌会议现场（深圳市律协供图）【给每栋楼都装上监控】邵明建议，超过10年以上的房屋，能否由政府进行监督检测。不管是哪个物业公司、或者过程中更换过物业公司，都要求按时间检测并提交检测结果。相关施工单位检测或者维修一次间隔多长时间，可以明确到责任人。邵明还表示，“我们能否推动政府在深圳的小区里优先来做，把外部监控事情做好。现在政府警察抓小偷的监控已经有了，泰豪水疗沐足城我们能否让政府推动外墙的监控。”对此，树宏玲律师提醒说，谈到监控的问题，目前我国属于治安管理的范畴，大部分监控都是由公安管理。“我赞同邵明主任的意见，在建筑物的某些位置安装监控，这是治安管理社会公共的问题。但它涉及到可能会侵犯个人隐私的问题，监控摄像头的广角不光是看外墙或某个角度，还可能深入到窗户里面。“她认为，防止高空抛物（坠物）问题不能简单地用监控防范或者查明其责任主体。”监控不仅涉及民事问题，还涉及刑事问题。不仅仅是小区业主委员会、业主大会决定安装就可以安装。一定要经过公安备案，在符合相应的技术条件、设备技术要求条件下才能安装。你不能因为保护一个权利去侵犯另一个权利。要明确，监控的管理者是谁？小区物业管理公司吗？他的权限局限于哪里，这是一个很复杂的方面。“曹长兴举了一个例子。福田某小区在安装监控前，很多人丢盒饭、丢垃圾、丢冰块。安装了监控摄像头后，再没有这类事件发生。可以说，杜绝了高空抛物。”因为住户都知道这里有一2018深圳福田站街组三个摄像头，对准不同的部位，业主心理上可能有一种压力。“曹长兴进一步建议说，摄像头可以设置为360度转动，可以让摄像监控机器人巡逻，不定期检视楼宇。这样的技术手段可以推广，人大代表也可以提出立法建议，”我们可以在业委会、业主大会使用物业维修专项基金，这是可行的“。王宁律师也认为，对于事先预防抛物和坠物，定期检查以及加装监控设施是最有效的。定期检查主要针对设施坠落的情况，监控设施主要针对主观故意抛物的情况。颜宇丹律师发言（深圳市律协供图）【物业公司要做什么？】曹长兴的观点是，在房屋质量方面开发商的责任在购房合同里有详细的约定，保质期内由于外墙的材料或者建筑缺陷造成的坠物，肯定是开发商的。5年后保质期过期后，即便产品设计有缺陷，开发商也没有直接的责任关系。颜宇丹律师分享了惠州物业公司的做法。她说，最近深圳出现高空坠物伤人的事故后，有惠州的物业管理公司就行动起来，跟业主签署不高空抛物保证书，”他们比深圳还积极”。即使是别墅只有三层楼的业主，也要签。物业公司非常警惕，提前为自己的管理做好防范。而且，物业公司也会经常派人巡逻。“她说，如果管理公司没有根据合同尽到防范、监管等责任应该是”不作为“。根据物业合同的相对性，我们可以以违约责任主张物业公司承担一定的责任。物业公司有安全杭州大肠水疗保证的义务，这是肯定的义务。如果物业公司对高空坠物和高空抛物的事件中违反安全保障要求，应该承担相应的侵权责任。【推动外墙强制维修立法】邵明关注的是建筑满5年后，住户对房子进行二次装修时的风险。“二次装修由谁做管控？比如小区房屋承重墙，理论上不能随便把它打掉，这对楼栋有很大的影响。仍然有一些小区或者有一些房屋这么做。如果物业公司不对此承担责任水围轻松释站会所（如提醒，制止），我认为不合理。物业公司对小区有服务的责任，也有一定的管理责任。”刘长森认为，指望物业公司把人为抛物这个损害降低或者消除，根本是不现实的。“我认为这是群体行为意识的问题，这和我们机动车礼让行人是一个道理。深圳机动车不深圳喜悦水会 玩法礼让行人抓到要扣分要罚500元，现在大部分机动车看到行人过马路会停车，这是非常大的改观。”他说，指望物业公司检查每家每户的窗子是否安全，这是不现实的。比如建筑物的共有部分，外墙瓷砖什么时候掉下来，物业公司不是专门的检测机构无法判断。这种情况下物业公司很吃亏，也有可能开发商贴瓷砖的时候没贴结实。树宏玲律师的建议是，有一点可以立法，要求物业管理处强制执行，即代为维修或者排除危险。她说，我国物业管理里把房屋维修责任明确，专有部分是产权人，共有部分是管理人。“我建议对这一块强制维修进行立法，可以通过深圳地方立法来做”，她说，深圳推动地方立法能成功的话，未来几年内应该可以落地。林志平律师指出，其实关于这方面《深圳市物业管理条例》有相关的规定。《深圳经济特区物业管理条例》第81条规定：物业贴面外墙等设施应当保持安全整洁，每5年至少修缮或者粉刷一次，费用从物业专项维修资金中支出。对于业主自有空调架、防盗网等外观设施应当每三年至少检修或者粉刷一次，费用由业主承担。也就是说关于安全检查或者物业维修方面，在深圳还是有明确的法律规定的，只不过因为费用承担和利益没有进行落实。“高空抛物的危害经过媒体报道后，我认为应该把相关的规定通过媒体或者各方面进行宣传，让这些规定得到落实”，他说。杨银笛律师发言（深圳市律协供图）【推动高楼责任保险制度】余刚律师发言中提到，“为什么我们关注这个问题？因为在座的每个人都是潜在的受害者。这种情况下，不亚于推行交强险的争论。当交强险没有出现时，机动车致人损害，责任由谁承担或者怎么承担的问题。现在我们能否在法律救济措施中实行高楼责任保险制度？利用保险杠杆的措施，无论责任人明确还是不明确，最终都得到让我们比较满意的结果。”他认为，在没有能力赔偿或者责任不明确的情况下，先由保险公司或者类似基金解决燃眉之急是最为合适的。“现在大家是通过献爱心、做良子足浴全套有哪些项目慈善解决受害者家庭问题，显然这是不能长久的。”林志平律师表示非常赞同余律师的发言。他说，在现有《深圳经济特区物业管理条例》修订草案特别提到保险，93条第三款是这样规定的：鼓励业主、业主大会、物业服务企业购买物业安全责任保险”，《深圳经济特区物业管理条例》草案考虑到保险问题。关于保险，物业安全责任保险可以设置专有名词“高空抛物险”，他认为可以参照汽车交强险，购买保险对自己来说是一种保护，更是一种保障。建议保险公司设立类似“高空抛物险”的新保险险种，适用于当前社会发展的大势。刘长森想到了更深层次的问题：保险公司肯定欢迎多一个新险种。”问题是保费费率按什么收？这个钱谁出？机动车交强险不一样，由车主支付。一栋楼这么多业主，是不是每个业主都要买这个保险？是不是每年购买？“刘长森认为，保险听起来很好，操作起来是非常难的。鼓励可以，强制购买抛物险不现实。万一，”真的有了保险，大家无所谓，都往下扔，（都想着）保险公司承担就完了。“杨银笛律师的观点是，如果强制购买公共责任险，是否可以从物业维修基金公共的部分支出？至于保费的计算，需要保险专业人士共同探讨。”我认为这种模式可以探讨，比如设置‘高空坠物安全基金’、安全责任保险。“颜宇丹律师提到，关于社会救济方面，要完善社会基金制度和保险制度。她说，救济基金，有些国家已经这么做，由政府、房地产开发商、业主设立基金，用于补偿因遭受高空抛物损害的受害人。建立高空抛物损害责任商业保险制度，可以补偿被保险人因意外事故受损的顺利。”目前，我国社会保险制度尚未完善的情况下，商业保险制度欠发达。建议设立高空抛物损害责任基金制度和保险制度，我认为有进一步探讨的空间。“【设立房屋安全日向其他国家和地区学习成功经验】刘长森建议说，深圳能否设置房屋安全选择日，在这一天全市业主自查房子。可以设在每年三月份最后一个星期日，他注意到这几次出了高空抛物事故在5、6月份，正是春天，雨势和风力都加大的季节。林志平分享了他所知道的日本、美国、中国香港的做法。日本有许多高层居民在第一和第二层之间设置安全网，把楼房包围一圈，从外面伸出去至少1．5米。楼上有东西坠落可以避免砸到行人。美国纽约有很多高楼窗户只能打开很小的缝隙，连一只胳膊都无法伸过去。曼哈顿的一些高层甚至不允许住户私自登上楼顶露台。我认为这些做法有效避免高空抛物事故的发生。中国香港香港成立了侦查高空掷物任务队，这个任务队专门聘请警方在不同的案发地巡逻部署，收集关于高空抛物的实践。如果发现高空抛物会马上进行公诉，对高空抛物的实施人实行公屋扣分制，违反规定不能取得公屋。
